1. scope of application
1.1 These General Terms and Conditions (GTC) shall apply to the entire business relationship between the company SLS Marketing GmbH - Schumann 7,83® and its corporate and private customers.

2.1 The presentation of Schumann 7,83® products, in particular on the Internet, shall not constitute a binding offer.

The contracting party consents to the storage and processing of all customer and delivery-related data by SLS Marketing GmbH by means of electronic data processing.
4 Order and delivery conditions
4.1 Orders shall be placed without exception in our online store or in the sales platform linked thereto.
4.2 Unless otherwise agreed, delivery shall be ex warehouse to the customer's address.
4.3 If SLS Marketing GmbH incurs additional shipping costs due to the indication of an incorrect delivery address or an incorrect detainer, these costs shall be reimbursed by the customer, unless he is not responsible for the incorrect indication.
4.3 Information on delivery periods shall in principle be non-binding unless the delivery date has been bindingly promised in an individual case. Partial deliveries are permissible. Agreed delivery periods shall apply subject to and foreseeable obstacles which are beyond the sphere of influence of SLS Marketing GmbH, in particular in cases of force majeure, shortage of materials, Covid 19 measures, etc. Claims for damages or cancellation of the contract shall be excluded due to delays in delivery.
5. terms of payment
5.1 The purchase price shall become due immediately upon acceptance of the customer's order. In principle, the customer is obliged to pay in advance. Payment shall be deemed to have been made on the day on which SLS Marketing GmbH can dispose of it.
5.2 Prices shall be deemed to be end customer prices and shall include statutory value added tax.
5.3 In case of default of payment, the end customer shall be obliged to pay default interest in the amount of 5% to SLS Marketing GmbH. If the customer is a dealer, the default interest rate shall be 8% above the base interest rate.
6.4 In the event of default, the customer shall be obligated to reimburse SLS Marketing GmbH for any reminder and collection fees incurred.

The shipment is always at the expense and risk of the customer. SLS Marketing GmbH shall not be liable for damages and losses during transport.
As a matter of principle, SLS Marketing GmbH shall ship all deliveries as insured parcels.
7. reservation of proprietary rights
The goods shall remain the property of SLS Marketing GmbH until payment has been made in full.
8 Liability and warranty
8.1 SLS Marketing GmbH warrants for a period of 24 months through the manufacturer's warranty that the goods have the warranted characteristics and do not have any defects which impair their value or suitability for the intended use. Excluded are scratches in the surface of the copper plates, as well as possible discoloration.
8.2 The buyer shall inspect the delivered goods upon receipt and report any defects immediately to SLS Marketing GmbH.
8.3 Damages caused by improper measures of the purchaser during unpacking or

10 Limitation of liability
SLS Marketing GmbH shall only be liable for damages caused by gross negligence.
11 Advertising and marketing
11.1 All business partners and dealers who buy and sell products of Home of Balance, in particular of the brand Schumann 7,83®, may expressly use only the photos, videos, images and texts released by SLS Marketing GmbH, Schumann 7,83® for their advertising and marketing, both online (social media, Google, Internet, online advertising texts) and offline. The same applies to the own online store of a business partner or dealer. If business partners or dealers do not comply with these requirements under point 11.1, SLS Marketing GmbH, Schumann 7.83® will immediately terminate the cooperation with the business partner or dealer and also take legal action against him.
If business partners or dealers wish to use their own photos, videos, images and texts in their online store and in their advertising and marketing, this must be sent by email to SLS Marketing GmbH, Schumann 7,83® and approved by SLS Marketing GmbH, Schumann 7,83® in written digital form by email.

SLS Marketing GmbH, Schumann 7,83® expressly points out that each business partner and dealer has been informed in detail about the products ordered by him for the vitalization of the room and the body and that no promises have been made that refer to the elimination, alleviation and healing of diseases.

13. Austrian law shall apply. The place of jurisdiction shall be the registered office of SLS Marketing GmbH.
